Terms of Service

These Terms of Service ("Terms") govern your use of the FlourishIQ website, courses, membership and tools (the "Service"). By creating an account or making a purchase, you agree to these Terms. FlourishIQ is part of a family of wellbeing brands (alongside FlourishTalk and InspireWell4Life) created by Dr Alten du Plessis. Please also read our Privacy Policy and Refund Policy, which form part of these Terms.

1. Your account

• You must provide accurate details and keep your login secure. You are responsible for activity under your account.
• Accounts are personal to you. Don't share your login or let others use your access.
• You must be old enough to enter a binding agreement in your country, or have the consent of a parent or guardian.

2. The courses & membership

• Courses are sold with a defined access period (typically 12 months from enrolment) unless stated otherwise.
• When an access period ends. Your access runs to the end of the last day of the period and closes automatically the next morning. This applies to purchased courses and to complimentary access given for a set period. We email you 14 days before the end and again on the last day.
• Your entries are kept. When access closes, nothing you wrote is deleted. If you buy the course again, it reopens with your entries intact, for another 12 months counted from the later of the day you buy and the day your previous access ends, so renewing early loses you nothing.
• Membership is billed each period and lets you add a course per period as described on the membership page. You may cancel at any time; you keep access to the period you've paid for.
• Group orders let you buy access for others, by email enrolment or redeemable codes, as described on the group pages.
• We may add, update, retire or re-organise courses and tools over time.

2a. Free 24-hour trials

• What is included. You may try any course that is for sale on FlourishIQ free of charge for 24 hours. During the trial you have full access to the whole course: every module, tool, reader, talk and workbook.
• When it runs. The trial starts when you confirm it and ends exactly 24 hours later. We show you the end time before you start, and email it to you.
• Account, no card. You need a free FlourishIQ account. No payment details are asked for, and nothing is charged when the trial ends.
• How many. Each course can be tried once per person. You can have one trial running at a time, and start at most three trials in any 30 days.
• What is excluded. Group and institutional offers, and courses sold on partner sites (such as SportSmart4Life), are not available as trials.
• Your entries. Everything you write during a trial is saved in your account and stays private to you. If you buy the course, during or after the trial, it opens again with your entries intact, for a full year from purchase.
• When it ends. Access to the course closes automatically, and we email you to let you know.
• Fair use and changes. Trials are for personal evaluation. We may decline or end trials that are misused, for example through multiple accounts. We may change or withdraw the trial offer, but a trial already started will run its full 24 hours.

3. Purchases, pricing & payment

• Prices are shown on the relevant page. Card payments go through PayFast and are processed by FlourishTalk, the name on your statement. Prices are in South African rand.
• We may change prices from time to time; the price you pay is the one shown at checkout.
• Refunds are governed by our Refund Policy.

4. Licence & acceptable use

When you buy or access a course, we grant you a personal, non-transferable, non-exclusive licence to use the course content for your own learning. You may not:

• copy, resell, sub-licence, publish or redistribute the content;
• share your account, or provide access to people who haven't paid;
• use the Service unlawfully, or attempt to disrupt or gain unauthorised access to it.

5. Intellectual property

All course content, tools, text, designs and branding are owned by FlourishIQ and its creator (and, where applicable, Stellenbosch University) and are protected by law. These Terms don't transfer any ownership to you.

6. Your content

Reflections and responses you enter into the tools remain yours. You grant us the limited permission needed to store and display them back to you and operate the Service. We treat them as private and handle them per our Privacy Policy.

9. Disclaimers & limitation of liability

We work hard to provide a reliable, high-quality Service, but we provide it "as is" and can't guarantee specific outcomes or uninterrupted availability. To the extent permitted by law, our liability arising from your use of the Service is limited to the amount you paid us for the relevant course or membership in the 12 months before the claim.

10. Suspension & termination

You may stop using the Service at any time. We may suspend or close an account that breaches these Terms or is used unlawfully. Where you've paid for access and have not breached these Terms, we'll honour the access you've paid for.

11. Governing law

These Terms are governed by the laws of the Republic of South Africa.

12. Changes

We may update these Terms from time to time. The "last updated" date above reflects the current version; continued use of the Service means you accept the current Terms.
